1C — What the School Must Provide Same Day

Under Ministerial Order 1125, the school must give families specific written information on the same day a suspension is considered.

Victorian government schools must give parents certain documents on the same day they consider a suspension. These documents ensure procedural fairness, accurate communication, and disability-aware decision-making.

If any of these documents are missing, unclear or incomplete, the suspension process may not meet the legal requirements under Ministerial Order 1125.

✔ Required Item 1 — Accurate Description of the Incident

The school must provide a factual written account of what happened, including:

  • time and location
  • staff present
  • sequence of events
  • what the student was doing before the incident
  • adult responses before and during the incident

✔ Required Item 2 — Evidence Considered During Investigation

This may include:

  • statements from staff
  • incident reports
  • witness notes
  • behaviour logs

✔ Required Item 3 — Review of Reasonable Adjustments

The principal must show which disability or learning adjustments were:

  • planned
  • implemented
  • monitored
  • in place at the exact time of the incident
Missing adjustments can render a suspension invalid under MO1125.

✔ Required Item 4 — Proposed Suspension Reason

The school must provide the proposed reason under MO1125, connected to the incident details.

✔ Required Item 5 — Opportunity for Parent Response

The school must show that families were:

  • given a chance to respond
  • offered a meeting
  • not pressured into agreeing verbally

✔ Required Item 6 — Principal-Only Decision Notes

Only the principal can make the decision. The assistant principal cannot.

✔ Required Item 7 — Safe & Clear Communication

The communication must be neutral, accurate and free from emotional framing.
