The National Disability Insurance Scheme (NDIS) provides support for people with permanent and significant disability. Advocacy helps people understand their rights, request fair decisions and navigate complex NDIS processes.

What Is NDIS Advocacy?

NDIS advocacy supports participants (or people seeking access) to:

  • understand their rights under the NDIS Act
  • navigate access and eligibility requirements
  • prepare evidence and documentation
  • request reviews of decisions (internal reviews)
  • appeal decisions at the Administrative Appeals Tribunal (AAT)*
  • resolve complaints with the NDIS Quality and Safeguards Commission
  • communicate with the NDIA, LACs, planners and providers

*Advocates support participants, but do not give legal advice unless legally authorised.

Rights Under the NDIS

The NDIS Act provides rights related to:

  • choice and control
  • reasonable and necessary supports
  • assessment that is evidence-based and fair
  • access to reviews and appeals
  • culturally safe communication
  • privacy, dignity and respect

Who Provides NDIS Advocacy?

NDIS advocacy may be delivered by:

  • disability advocacy organisations (state and national)
  • community legal centres (NDIS-specific matters)
  • First Nations disability organisations
  • multicultural and settlement organisations
  • specialist disability services
Important: LACs, planners and support coordinators are not independent advocates.

Common NDIS Advocacy Issues

  • access rejections or delays
  • plan cuts or insufficient funding
  • assistive technology requests being declined
  • transport funding issues
  • unfair risk assessments
  • limited support coordination availability
  • provider conflicts or unsafe practices

Culturally Safe NDIS Advocacy

Advocacy must be culturally responsive, especially for:

  • First Nations participants
  • CALD (culturally and linguistically diverse) communities
  • refugee and migrant communities
  • people with limited English proficiency

Culturally safe advocacy respects communication preferences, family decision-making practices, cultural identity and language needs.
